These Terms govern your use of equalcre.org (the “Site”), operated by Tkach Ventures, Inc. (“Equal CRE,” “we,” “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About the Site

The Site describes Equal CRE's software and advisory services for public programs and the businesses they serve. Content is provided for general informational purposes and may change without notice.

2. Not professional advice

The Site and its contents do not constitute legal, financial, tax, accounting, investment, or professional real estate advice, and should not be relied upon as such. Using the Site does not create an attorney–client, broker–client, fiduciary, or other professional relationship. You should consult qualified professionals before making decisions based on information found here.

3. No guarantee of outcomes

Eligibility for a license, grant, or program does not guarantee that an applicant will obtain, finance, or occupy commercial space. Outcomes depend on many factors outside our control — including market conditions, third-party approvals, and applicant circumstances. We make no guarantee or warranty regarding results, timelines, approvals, or financial outcomes.

4. Compliance determinations

Equal CRE's tools and materials are preparation and technical-assistance resources. They are not a substitute for official review, and all compliance, licensing, zoning, and permitting determinations remain with the applicable governmental authority.

5. Cannabis & federal law

Cannabis remains a Schedule I controlled substance under the U.S. federal Controlled Substances Act; its cultivation, possession, distribution, and sale remain illegal under federal law regardless of state law.

Equal CRE provides advisory, technical-assistance, and real estate services solely in connection with activity that is licensed and regulated under applicable state and local law. Nothing on the Site is an offer, solicitation, inducement, or facilitation to engage in any activity that violates federal law, and nothing here is legal advice regarding the legality of cannabis-related activity.

6. Real estate brokerage disclosure

Real estate brokerage services are provided through Tkach Ventures, Inc., a licensed California real estate broker — California DRE License #02049736; Broker of Record: Yan Tkach. The California Department of Real Estate regulates real estate licensees; licensee information is available at dre.ca.gov.

7. Testimonials

Testimonials and case studies reflect the individual experiences of specific clients and are not a promise or guarantee that you will achieve the same or similar results.

8. Intellectual property

The Site, its content, and the underlying software platform are owned by Equal CRE or its licensors and are protected by intellectual-property laws. The platform is proprietary: it is configured and deployed for a program's use, and Equal CRE retains ownership of the technology. You may not copy, reproduce, or create derivative works from the Site without our written permission.

9. Third-party links & services

The Site may reference or link to third-party websites and services we do not control. We are not responsible for their content, availability, or practices, and a link does not imply endorsement.

10. Limitation of liability

To the fullest extent permitted by law, Equal CRE and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of (or inability to use) the Site. The Site is provided “as is” and “as available,” without warranties of any kind, express or implied.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The exclusive venue for any dispute will be the state and federal courts located in Los Angeles County, California.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision, and your continued use of the Site constitutes acceptance of the updated Terms.

13. Accessibility

Equal CRE is committed to digital accessibility and strives to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA.
